National Amusements $100,000 Critic Challenge THIS PROMOTION IS INTENDED FOR PLAY IN THE UNITED STATES ONLY. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Entrants will need a code found on the front of each National Amusements $100,000 Film Critic Challenge Instant Win Game game card. Game cards will be distributed at participating National Amusements locations between 2/1/10 and 3/4/10 (while supplies last) and are also available by mail (while supplies last). See National Amusements $100,000 Film Critic Challenge Instant Win Game Official Rules for details on how to request a game card by mail. 1) Eligibility: Participation in the $100,000 Film Critic Challenge (the “Promotion”) is open to legal residents of CT, MA, NJ, NH, NY, PA, or RI who are 14 years of age or older at the time of entry. Employees, officers, and directors of Sponsor, Administrator and each of their affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, Individuals engaged in the development, production or distribution of materials, their advertising and promotion agencies, and any and all other companies associated with the Promotion, and each such individual’s immediate family members (spouse, siblings, parents, children and their spouses) and anyone living in the same household as each such individual, are not eligible to participate. 2) Agreement to Official Rules: By participating in this Promotion, each entrant agrees to abide by these Official Rules and the decisions of the Administrator, which are final and legally binding as they pertain to this Promotion. All entries become the property of the Sponsor. 3) Timing: Promotion starts at 12:01 am Eastern Time (“ET”) on Monday, February 1, 2010 and ends 11:59 pm ET on Thursday, March 4, 2010 (the "Promotion Period"). The clock maintained by the Administrator in connection with the operation of the Promotion at the Promotion website (the “Website”) will be the official timekeeper for this Promotion. 4) How to Enter and Play: The Promotion consists of a Grand Prize Sweepstakes and a Contest. During the Promotion Period, visit www.nationalamusements.com, click on Promotion icon or banner and follow the instructions to complete and submit the online registration form. You will be required to enter a valid code from the front of a National Amusements $100,000 Film Critic Challenge Instant Win Game game card. Upon submitting your registration, you will automatically receive one (1) entry into the Grand Prize Sweepstakes. You may also enter the Grand Prize Sweepstakes by mailing a postcard containing your full name, complete address, city, state, ZIP code, age, email address and telephone number, to be received by 3/8/10 to, National Amusements $100,000 Critic Challenge, PO Box 2312, Framingham, MA 01703-2312. LIMIT: One Sweepstakes entry per person or email address over the course of the Promotion Period. Upon submitting your registration, you will also advance to the Contest page where you can select the twenty (20) Academy Award® category winners. How to enter your category picks: The contest page will contain twenty (20) Academy Awards® categories. Nineteen (19) categories will contain five (5) picks and one (1) category will offer ten (10) picks. The objective of the Contest is to correctly pick all twenty (20) category winners. Each correct pick will receive one (1) point. Correct answers to each category will be determined by the results of the 2010 Academy Awards® television broadcast scheduled for March 7, 2010. The entrant (or entrants) that receives 20 points will be declared the winner(s), subject to verification. LIMIT: One (1) Sweepstakes/Contest entry per person and per email address. Sweepstakes Drawings & Winner Selection: A random Sweepstakes drawing will be conducted on or about Monday, March 8, 2010 from all valid entries received. LIMIT: One prize Sweepstakes prize per person/household. The Sweepstakes drawing will be under the control of the Administrator whose decisions shall be final and legally binding as they pertain to this Sweepstakes. Winner will be notified within 10 days of the drawing via phone, email, mail or express mail whichever is appropriate. Failure to reply to this prize winning notification within 10 days of notification to claim prize, will disqualify the entry and an alternative winner will be selected from all eligible entries received for the Sweepstakes. Odds of winning depend on the total number of eligible entries received. 6. Prizes: ONLY THE NUMBER OF PRIZES LISTED BELOW WILL BE AWARDED IN THIS PROMOTION. 6) ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY THE ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND LEGALLY BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNTIL ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING CATEGOREY PICKS HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR COPIES OF SCREEN CONTENT OR ANY OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED. 7) Potential Game Winners: ALL potential winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. If a potential winner cannot be contacted, or if notices or prizes are returned as undeliverable, that prize will become null and void and will not be awarded. If any prize is not awarded during the Promotion Period or remain unclaimed, that prize will become null and void and will not be awarded. 8) Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor's or agents use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes relating to the announcement of winners of the Promotion in any media without further payment or consideration. 9) General Conditions: Sponsor and/or Administrator may cancel or modify the Promotion or these Official Rules if fraud, technical failures or any other factor beyond their control impairs the integrity of the Promotion, as determined by Sponsors and the Administrator in their sole discretion. In such event, Sponsors may award the Sweepstakes prizes at random from among the eligible entries received up to the time of the impairment. Sponsor and Administrator may, in their sole discretion, disqualify any individual they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsor and/or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Incomplete, illegible or mutilated entries will be automatically disqualified. No responsibility is assumed for lost, late, misdirected, damaged, altered, postage due or illegible entries. Any attempted form of entry other than as described herein is void. Administrator and or Sponsor will determine in it sole discretion what constitutes a valid entry. 10) Release: By entering entrant agrees to hold harmless and indemnify the Sponsor, Administrator, Promotion Entities, and their respective parents, subsidiaries, affiliates, dealers, directors, stock holders, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant's participation; or (ii) the receipt or use of the prizes awarded in the Promotion. 11) Limitations of Liability: Sponsor, Administrator and the Promotion Entities are not responsible for, and entrant hereby releases Sponsor, Administrator, and the Promotion Entities from any claims arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion. 12) Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the Commonwealth of Massachusetts; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the Commonwealth Of Massachusetts, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Massachusetts. 13) Participants Personal Information: By entering into this Promotion, each entrant agrees to Sponsor’s and Promotion Entities’ use of his or her personal information as described in the Website’s Privacy Policy and these official Rules. In the event of any discrepancy, these Official Rules shall control and govern.
